Terms of Service
1. Overview
These Terms of Service govern your use of Checkout Collective's development subscription service. By subscribing, you agree to these terms. If you don't agree, don't subscribe.
Checkout Collective LLC is a New York limited liability company operated by Bailey Paserk ("we," "us," "our"). You are the subscribing business or individual ("you," "client").
2. The Service
Checkout Collective provides Shopify Plus front-end development on a monthly subscription basis. This includes landing pages, custom sections, Build Your Own Bundle experiences, subscription flows, cart and checkout customizations, app integrations, and related Shopify development work.
What we don't include:
- Full custom app development
- Copywriting
- Paid media or marketing strategy
3. How Requests Work
- You may submit unlimited requests to your project queue
- We work one active request at a time on the Standard plan
- Most requests are completed within 2–3 business days; complex requests may take longer and we will communicate timelines upfront
- All deliverables are sent to a preview link for your review and approval before going live
- Requests must be for Shopify development work within the scope described above
We reserve the right to decline requests that fall outside scope. If a request is out of scope, we'll let you know and discuss options.
4. Payment and Billing
- Subscription fees are charged monthly via Stripe at the start of each billing cycle
- All fees are in USD
- Payment is due at the time of subscription and on each renewal date
- We do not offer refunds for partial months except in cases where we are unable to deliver service
- Prices are subject to change with 30 days written notice
5. Pause and Cancellation
Pausing: You may pause your subscription at any time. Billing pauses with it. Unused days carry forward to your next active period.
Cancellation: You may cancel at any time with no cancellation fee. Cancellation takes effect at the end of your current billing period. You will not be charged for the following month.

6. Intellectual Property
You own the code. All work we deliver to you becomes your property upon payment. We retain no ownership or license over deliverables once delivered and paid for.
We may use screenshots or general descriptions of work in our portfolio or marketing unless you request otherwise in writing.
7. Access and Cooperation
You agree to provide us with necessary access to your Shopify store, GitHub repository, and any relevant tools required to complete your requests. Delays caused by lack of access or delayed approvals are not our responsibility.
8. Limitation of Liability
To the fullest extent permitted by law, Checkout Collective's total liability for any claim arising from these terms or the service shall not exceed the amount you paid in the 30 days preceding the claim.
We are not liable for indirect, incidental, or consequential damages including lost revenue, lost data, or business interruption.
9. Warranties
We warrant that our work will be performed in a professional manner consistent with industry standards. We do not warrant that our work will increase conversion rates, revenue, or any specific business outcome.
10. Termination
We reserve the right to terminate your subscription if:
- Payment is not received
- You engage in abusive, threatening, or inappropriate behavior toward our team
- You request work that is illegal or violates Shopify's terms of service
11. Governing Law
These terms are governed by the laws of the State of New York. Any disputes will be resolved in the courts of Genesee County, New York.
12. Changes to These Terms
We may update these terms from time to time. We'll notify you by email at least 14 days before any material changes take effect. Continued use of the service after changes constitutes acceptance.
